The general terms and conditions of sale (GTCS) presented below comprise x articles and govern sales made by Montres Iconiques SAS (the Company) through its trade name, 41 WATCH (the Brand). The General Terms and Conditions of Sale presented below concern exclusively the company Montres Iconiques SAS and any individual or legal entity (the Customer) making a purchase on the 41Watch.com website or through one of the company's physical sales locations, including the showroom located at 39 rue de Verneuil, Paris 75007.

As the General Terms and Conditions of Sale may be modified at any time, the user of the website (the User) and the Customer acknowledge that they are aware of the General Terms and Conditions of Sale in force at the time of placing an order. By placing an order, the Customer expressly accepts all the terms and conditions in force at the date of purchase.

The Customer may place an order by various means (website, telephone, showroom, etc.). For orders on the www.41WATCH.com website, contractual information is presented in French. Orders on the 41WATCH.com website are placed via a secure connection.

41WATCH reserves the right, in the case of orders coming from a foreign country with a payment presenting a suspicious character (suspicious bank card, banking risk, customs risk...) not to proceed with the delivery of the order without having carried out additional checks which could delay delivery times.

41WATCH also reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment of a previous order.

Any order from the Customer, which has been confirmed by a payment of at least 25% of the total amount, constituting the necessary deposit, is considered firm and definitive, as from its receipt by 41WATCH.

Any modification of an order, for whatever reason, requires the prior written agreement of 41WATCH. Delivery of an order will only be made on receipt of full payment of the order by the Customer.

In the case of orders for watches that are not in stock (“Order”), Montres Iconiques SAS undertakes to deliver the ordered watch within 30 days, and to refund your deposit if the order is not honored. An order may be extended beyond 30 days by mutual agreement, in which case it may be cancelled at any time by either party by simple notification, with the deposit being reimbursed in full. In the event of withdrawal by the customer within 30 days (non-payment of the order in full within 30 days constitutes withdrawal in itself), the 25% deposit used to confirm an order is non-refundable, except in exceptional cases agreed in advance. The customer has 10 days from the date of availability of the watch to pay for the order in full. After this period, the reservation will no longer be effective and the watch will once again be available for sale by Montres Iconiques.

All prices indicated are public prices and are in euros, all taxes included, excluding the cost of preparing and shipping the product. In the event of an order to a country other than metropolitan France, any customs duties or local taxes will be borne by the recipient. All orders, whatever their origin, are payable in euros.

41WATCH reserves the right to modify its prices at any time, however any product purchased will be invoiced on the basis of the prices in force at the time the customer order is registered. In all cases, the price to be paid by the Customer is that indicated in the order confirmation and the corresponding invoice.

The products remain the property of 41WATCH until full payment of the price by the Customer.

41WATCH offers the purchase or trade-in of second-hand watches or deposit-sale directly to private individuals. The Customer may offer his products to 41WATCH from the website www.41WATCH.com via the “sell your watch” section. All products offered to 41WATCH will be appraised by our watchmaking experts, who will estimate the product's sale value, based in particular on the prices recorded on our price monitoring tool, PriceTracker.

Each offer formulated by 41WATCH, whether for a firm trade-in or a deposit sale, is a personalized offer, based on market liquidity at the time the proposal is made to the customer.

Any item entrusted to 41WATCH for deposit-sale is subject to a value guarantee in favour of the Customer (in the event of loss, theft or deterioration) equivalent to the estimated price at the time of deposit-sale less the amount of the commission on sale which would be due to 41WATCH. The certificate of deposit-sale given to the seller acts as an inventory of fixtures in the event of return of the product placed on deposit-sale.

41WATCH reserves the right to return to the seller any product placed on deposit-sale if it deems this necessary, with 48 hours' notice. Likewise, the seller undertakes to notify 41WATCH at least 48 hours in advance if he wishes to withdraw his product from deposit-sale, without it being necessary to invoke any reason whatsoever.

Our product offers and prices are valid as long as they are visible on the site, within the limit of available stocks. Our product offers are subject to availability. We endeavour to publish stock availability on our site in real time.

Indications of product availability are provided in any case when you place your order. In the event of product unavailability after your order has been placed, 41WATCH will indicate a new delivery date without delay and by all means, as soon as we receive the information. In this case, the customer may cancel the order and be reimbursed for any deposit paid to 41WATCH.

Reimbursement will be made, at 41WATCH's discretion, by crediting the Customer's bank account or by cheque, at the latest within thirty days of payment of the sums paid by the Customer.

In the event that a product is unavailable, 41WATCH may deliver to the Customer another product of equivalent quality and price to that initially ordered, subject to the Customer's express agreement.

In the event of default, 41WATCH reserves the right to cancel all or part of orders already paid for, and in this case undertakes to reimburse the Customer by any means for any sums already paid.

Montres Iconiques SAS customers are informed of the hazards of the “second market”, namely that supply conditions remain uncertain, and that Montres Iconiques SAS may occasionally be unable to deliver.

All orders will be processed upon receipt of full payment from the Customer. The time required to validate payment and dispatch the order varies according to the payment method chosen. In any event, 41WATCH reserves the right not to proceed with the delivery of an order if there is any doubt as to the integrity of the Customer's payment.

The products ordered are delivered to the delivery address indicated by the Customer during the ordering process. 41WATCH cannot be held responsible in the event of an error in the delivery address indicated by the Customer.

The average delivery time is 6 to 8 working days from the date of order by the Customer, and a minimum of 48 hours from the date of receipt of full payment by the Customer. These times correspond to the usual processing and delivery times for metropolitan France. For orders from abroad, delivery times may vary according to various parameters (payment method, country of delivery, customs charges, etc.).

The Customer may request the cancellation of his order if delivery has not taken place, at the latest, fifteen (15) working days after the delivery date indicated by 41WATCH, unless this delay in delivery is due to a case of force majeure within the meaning of the jurisprudence of the French courts, to an error in the delivery address indicated by the Customer, to the non-receipt of the Customer's payment or to a default in performance/forwarding by the carrier in charge of delivery.

The Customer must indicate on the delivery note, before any signature, any missing, damaged or non-conforming package or product. 41WATCH uses the services of delivery companies specialized in valuable goods. For this reason, the delivery rates indicated with each order include shipping costs, as well as value insurance (reimbursement of the product in the event of loss or theft) and any customs charges. For this reason, the delivery rates indicated with each order include postage costs, as well as value insurance (refund of the product in the event of loss or theft) and any customs charges. In the event of proven loss or theft, 41WATCH will contact the carrier and its insurance company(ies) in order to request a refund/indemnity, and will endeavor to offer a replacement/substitution solution wherever possible, at the same price conditions as for the item found to have been stolen/lost.

Delivery charges are payable by the Customer and are applicable according to the information provided by 41WATCH. For all internet orders, delivery charges are automatically added to the price to be paid including VAT. For orders placed by other means (telephone, showroom, etc.), delivery charges will be invoiced to the customer. Delivery rates may be modified at any time by 41WATCH, but delivery charges will be invoiced on the basis of the rates in force at the time the Customer's order is registered.

The www.41WATCH.com website uses a secure payment platform with the 3DSecure system, which guarantees optimum protection of your bank details. With the 3D Secure system, you will receive an SMS on your cell phone with an online payment validation code.

Payment is made in cash, either by credit card (Visa, MasterCard) or by bank transfer (RIB + IBAN). In certain cases, 41WATCH may accept payment for all or part of an order by deducting the trade-in value from the purchase price. This possibility remains at 41WATCH's discretion, in particular with regard to the trade-in value following the expertise of its team.

Advances, deposits or deposits paid by the customer are non-refundable, except in the case of amounts paid as part of a credit application which has not been accepted by the credit institution. After a period of 1 month without payment of the totality of the order, the product will be put back on sale and the order will be automatically cancelled. 41WATCH will keep the sum received as damages for the prejudice suffered.

In accordance with the law in force, the Customer has a cooling-off period of 14 days from receipt of the products to request a refund. However, the cost of returning the product is borne by the Customer, who must ensure that the product is delivered by secure express delivery using a carrier specializing in valuables.

Refunds may be made by the same means of payment as for the purchase, or by another means of payment at no additional cost to the Customer. Please note that in the case of payment by credit card (online or at the showroom), 41WATCH will reimburse the Customer by deducting the collection fees related to the initial payment made by the Customer.

In the case of a purchase or reservation with pick-up in a 41WATCH boutique or showroom, the fourteen (14) day cooling-off period does not apply.

In accordance with article 1 of the General Terms and Conditions, in the case of a withdrawal concerning orders for watches that are not in stock (“Order”), the deposit is non-refundable except in exceptional cases agreed in advance.

The www.41WATCH.com website is subject to a security system for payment methods and personal data: we use the SSL encryption process, a payment platform as well as all scrambling and encryption processes to protect all sensitive data linked to payment methods as effectively as possible.

The 41WATCH trademark is registered with the INPI. All texts, comments, works, illustrations and images reproduced on the www.41WATCH.com site are reserved under copyright and intellectual property law worldwide.

All used watches purchased from 41WATCH are guaranteed for 1 year (12 months) from the date shown on the invoice. During this period, 41WATCH undertakes to repair free of charge any major manufacturing defects existing at the time the watch is delivered. However, the warranty on a watch does not cover: a problem caused by an accident, a problem caused by water, a problem caused by incorrect handling of any kind, a problem caused by lack of care or interventions by unauthorized third parties and any consequential damage due thereto, a problem caused by wear or damage to the battery, bracelet, case and glass, pushers and crown.

This contract is governed by French law. The language of this contract is French.

In the event of a dispute, the French courts within the jurisdiction of 41WATCH's registered office shall have exclusive jurisdiction.

41WATCH is registered with the CNIL under n° xxxxxx. 41WATCH undertakes not to divulge to third parties any information, considered confidential, that you may communicate to us. It will only be used to process your order and to reinforce and personalize the communication and product offer reserved for 41WATCH customers, in particular through newsletters to which you have subscribed. In addition, the 41WATCH.com e-commerce site uses cookies to better meet the expectations of its customers and visitors. Cookies are therefore only used by 41WATCH to improve the personalized service provided to you.

41WATCH offers its customers, within the framework of a sale, financing which requires the preparation of a financing file which is submitted to the lender. 41WATCH acts as an intermediary between the borrower and the lender, and is therefore not responsible for approving or declining a loan.

The granting of credit commits the borrower. By taking out a loan with the lender, the customer acknowledges and accepts the obligations arising from it.

The borrower undertakes to repay the loan in full in accordance with the agreed terms. The repayment schedule, interest rate and duration of the loan are specified in the loan contract signed between the lender and the borrower.

Advance payment conditions :

If the financing application has not been accepted by the lending company, the deposit will be reimbursed in full.

If the financing application is cancelled by the borrower, even though it has been approved by the lending institution, a handling fee, at 41WATCH's sole discretion, may be applicable, in addition to the conditions set out in Article 7 of the General Terms and Conditions.

If, after review, a financing application is found to be fraudulent or misleading, a specific processing fee of up to €1,000 will be retained.
